The results of accredited entities activities monitoring of surveillance and reassessment

As part of the functions to monitor the activities of accredited entities, the Federal Service for Accreditation conducts regular monitoring of the activities of accredited entities who have evaded from the procedure of surveillance and reassessment.

Thus, according to the results of monitoring RusAccreditation has suspended the accreditation of 190 accredited entities in December 2017 who violated the requirements of Federal Law No. 412-FZ of December 28, 2013 «On Accreditation in the National Accreditation System» and did not pass the procedure of surveillance and reassessment of an accredited entity within the statutory time limits.

The decision to conduct surveillance or reassessment of an accredited entity is made on the basis of an application made in a prescribed form, received by RusAccreditation from the accredited entity no later than 20 working days before the date of surveillance or reassessment.

If there is no relevant application in the Federal Service for Accreditation to pass the procedure of surveillance or reassessment of an accredited entity received within a specified period, the accreditation of the entire scope of accreditation will be suspended, and the accredited entity will be notified with an indication of the deadline for eliminating the revealed non-compliance with the requirements of the legislation of the Russian Federation.

Failure to comply within the period of the non-conformance indicated in the notice on suspension of the validity of the accreditation or refusal to undergo the procedure of surveillance or reassessment of the accredited entity shall entail the termination of the accreditation.

At the same time, a legal entity or an individual entrepreneur in respect of whom a decision to terminate the validity of accreditation pursuant to clause 22 (1) 5) of the Accreditation Law has been authorized to apply for accreditation to the national accreditation body not earlier than two years from the date adoption of such a decision.

Legal entities with several accreditation certificates should pay attention to the fact that in the event when a legal entity does not carry out activities on one of several accreditation certificates and does not intend to undergo the procedure of surveillance or reassessment of an accredited entity, it has the opportunity to apply to the national accreditation body for termination of activities in the scope of accreditation on the relevant accreditation certificate.
