Starting from April 13, The Federal Service for Accreditation will apply a risk-based approach to the state control over the activities of accredited persons
The Prime Minister Dmitri Medvedev signed the decree of the Government of the Russian Federation “On the Federal State control over the activities of the accredited persons”, developed by the Ministry of Economic Development of Russia with the participation of the Federal Service for Accreditation. The document consolidated the Regulation that determines the procedure for the organization and implementation of federal state control over the activities of legal entities and individual entrepreneurs accredited with the national accreditation system.
The Regulation establishes the tasks of state control over the activities of accredited persons – prevention, detection and suppression of violations by accredited persons individuals of the requirements established by Federal Law No. 412-FZ dated December 28, 2013 "On accreditation with the national accreditation system", other federal laws and regulatory legal acts, as well as the adoption of measures stipulated by the legislation of the Russian Federation to suppress and (or) eliminate the consequences of violations of these requirements.
The state control over the activities of accredited persons shall be carried out by the Federal Service for Accreditation by conducting unscheduled documentary and (or) field inspections, implementing measures to prevent violations of mandatory requirements, control measures, without interaction with accredited persons, and through systematic monitoring of compliance with the mandatory requirements.
Unscheduled inspection of an accredited person shall be carried out in case of identification of the parameters of its activities, compliance with which or deviation from which indicates a high probability of violation of its mandatory requirements. It shall be determined in accordance with the indicators of the risk of violation by accredited persons of the mandatory requirements approved by the Ministry of Economic Development of Russia.
In this regard, state control over the activities of accredited persons is included in the list of types of state control (supervision) that are implemented using a risk-based approach (approved by the Resolution of the Government of the Russian Federation No 806 dated August 17, 2016).
The Regulation also establishes the procedure for the preparation by authorized officials of the Federal Service for Accreditation of a reasoned presentation on the basis of which unscheduled inspection shall be conducted or other control measures shall be carried out in relation to an accredited person.
The document is aimed at reducing the administrative burden on bona fide subjects of entrepreneurial activity and improving the effectiveness of control and supervision activities while maximizing the savings of material, financial and human resources of state control (supervision) bodies.
The Resolution approved by the Government of the Russian Federation shall enter into force on April 13, 2017.
